The NYMFMPA is intended to preserve, promote and encourage competition in the motor fuel industry in New York State. The law identifies and specifically defines certain marketing practices that impair fair and healthy competition and, if continued, would harm consumers.
The New York State Consumer Protection Board (CPB) may investigate complaints filed by petroleum industry participants of alleged violations of the law. Violators are subject to a civil penalty of up to $10,000 per violation not to exceed, $250,000. Each day that a violation occurs is considered a separate violation.
